Why make a Trust?
The benefits of making a Trust including:
- Tax planning – by putting assets into a Trust you will help to avoid inheritance tax liability on those assets when you die. In some circumstances you can also avoid paying capital gains tax straightaway.
- Keep control – by putting assets into a Trust that you are one of the Trustees of you will remain in control of those assets. You may want to give assets to your children but feel they are too young to be responsible for them or worry they may simply sell them against your wishes. By putting the assets into Trust you can protect against these issues.
- Divorce/bankruptcy – if you put assets into a Trust it should prevent it becoming lost in the event of divorce, bankruptcy or death.
- Care home fees – if you put your home into a Trust, you may avoid the local authority being able to assess your home as part of your assets when deciding whether you can afford to pay care home fees.
